Position Overview

This is a part-time, flexible Of Counsel position ideal for an experienced Georgia probate attorney who can confidently handle court appearances, hearings, probate filings, and client communications with minimal supervision.

The Part-Time Probate Litigation Attorney will handle contested and uncontested probate matters, appear at hearings in Metro Atlanta and surrounding area probate courts, and take the lead on litigation-related strategy. You will work closely with the managing partner and paralegal team, stepping in for court, motion hearings, mediation, and status conferences as needed.

Key Responsibilities

Prepare and file initial probate petitions and supporting documents, including:

  • Petitions to probate in solemn form or common form
  • Petitions for temporary or permanent administration
  • Petitions to open an estate when no will exists
  • Required notices, consents, waivers, and related filings

Attend court hearings to open probate estates and conduct routine probate calls, including status checks, initial hearings, motions, and calendar calls.

Handle probate litigation and contested estate matters, including:

  • Will contests and caveats
  • Objections to appointment of PR/administrator
  • Petitions to remove fiduciaries
  • Accounting disputes
  • Year’s support objections and hearings
  • Emergency/expedited petitions

Conduct court appearances in Fulton, Cobb, Gwinnett, DeKalb, Forsyth, and surrounding Georgia counties

Attend probate litigation calls, including status checks, motion calendars, and hearings

Draft litigation-related pleadings, including:

  • Caveats
  • Motions
  • Objections
  • Petitions
  • Briefs and supporting affidavits

Develop litigation strategy in coordination with the managing partner

Communicate with heirs, beneficiaries, opposing counsel, probate court clerks, and personal representatives

Handle discovery when applicable (interrogatories, subpoenas for bank records, depositions coordination)

Participate in mediation or settlement negotiations

Manage court deadlines and ensure compliance with probate procedural rules

Review and interpret estate documents, financial statements, and fiduciary filings

Maintain accurate time entries and contribute to organized case management

Qualifications

  • Active Georgia law license (required)
  • 5+ years of experience in probate litigation or contested estate matters
  • Strong courtroom presence; comfortable arguing motions and navigating probate judges’ preferences
  • Experience with contested appointments, caveats, and fiduciary-removal proceedings
  • Familiarity with Odyssey eFileGA, PeachCourt, and county-specific filing rules
  • Strong legal writing and strategy development skills
  • Ability to work independently with minimal supervision
